We are now less than a day away from the start of Brian Walshe's high-profile murder trial. Opening statements are scheduled to begin Monday.
It's now been almost three years since Walshe was charged with murdering his wife Ana.
He's accused of dismembering and discarding her body -- and her remains have never been found.
Walshe pleaded guilty to two out of the three charges against him -- unlawfully disposing of her body and misleading investigators. He now faces the main charge of murder, with opening statements starting Monday morning.
"Typically an opening statement is going to be a lay of the land, what each side expects the evidence to be," criminal defense attorney Elyse Hershon explained. "Based on my experience, the defense is not going to commit to whether Brian Walshe is going to testify, but we will know what they're theory is tomorrow."
The case will now focus on the main charge for the murder of Ana Walshe, with prosecutors having to prove Brian Walshe killed his wife without a body.
"Without knowing how Ana Walshe died, they are going to have some trouble, I think, coming up with that," Hershon said. "They're going to have to prove this through circumstantial evidence, without an eyewitness, without having this on video and without a body saying how exactly she died."
Prosecutors expect the case to last about 2-3 weeks, and law experts say we can expect to hear from witnesses as soon as Monday.
"I assume the Commonwealth's witnesses will take us through the end of the week and into next week," Hershon said. "It's hard to tell how many witnesses they're going to call."
No matter what happens, we can definitely expect some major developments are coming in the next couple of days.
