A Bloomingdale man has been charged with shooting at another man after a traffic dispute in Roselle Thursday.
Marcus Mizelle, 23, of the 300 block of Windsor Drive, is charged with aggravated discharge of a firearm at a person or vehicle and aggravated assault ‒ discharge of a firearm from a motor vehicle.
The victim was not injured.
Prosecutors asked to have Mizelle detained pretrial, but DuPage County Judge Joshua Dieden denied the request Friday morning. Instead, he ordered Mizelle to surrender any guns and ammunition, as well as his firearm owners identification card and his concealed-carry license.
Police were called to the BP gasoline station at 590 W. Lake St. for reports of gunshots.
Authorities allege that Mizelle and the victim were driving north on Springfield Drive in different lanes when Mizelle cut in front of the victim due to a bottleneck caused by a school bus ahead of the men.
The men pulled into the gasoline station. Authorities say the victim got out of his vehicle and approached Mizelle's, and Mizelle then showed a pistol outside his window and fired a shot, then left the area.
According to a petition for detention, Mizelle told police the victim followed him to the station, approached him in a threatening manner, and kicked at his vehicle. Mizelle said he fired a shot in the air because he feared for his life. However, according to the petition, police said a witness and surveillance video did not show the victim kicking the car.
